NHRCK Celebrates the Anniversary of Centralizing Sex Discrimination Cases

On June 23, 2006, the NHRCK celebrated the anniversary of undertaking sex discrimination and sexual harassment cases. Sex discrimination and sexual harassment cases used to be dealt with by both the NHRCK and the Ministry of Gender Equality and Family, but now those cases fall under the sole jurisdiction of the NHRCK‘s Sex Discrimnation Team. For reasons including the fact that the public was confused as to where to file sex discrimination claims, it was decided that it would be more efficient for the NHRCK to deal with all sexual harassment and sex discrimination cases which often involve elements of other types of discrimination and human rights violations.
For the past year, the NHRCK received a total of 151 cases of which 99 were sexual harassment cases and 52 were sex discrimination cases. Of these cases, 73 sexual harassment cases and 54 (past cases included) sex discrimination cases were concluded by the NHRCK in the past year.
Out of the 73 concluded sexual harassment cases, excluding the 51 cases that were dismissed or for which investigation was discontinued, there were 4 cases of recommendation for reform, 3 cases of successful mediation, and 8 cases that were resolved by mutual agreement. A total of 54 sex discrimination cases were concluded in the same period and there were 7 cases of remedial recommendation and 1 case of mutual agreement.
The NHRCK went further than making recommendations in individual cases and focused on initiating fundamental changes to sexually discriminating practices by making recommendations in relation to the reform of the system, policies and laws. Some examples of such recommendations include recommendation to abolish separate recruitment procedure limiting the number of women recruits in the police force, recommendation to a particular university to abolish the limitation of women students to 10% of the total number of freshman enrolled, and policy recommendation to reform the system for accrediting work experience of farmers that was discriminatory to women farmers.
The NHRCK Sex Discrimination Team also held a discussion forum with women" s organizations to evaluate and review the performance of the team after the transfer of jurisdiction of the sex discrimination cases. It was pointed out that in dealing with sexual harassment and sex discrimination cases, it was important to observe the sex discriminatory practices and culture embedded within the surface of the particular situation. Furthermore, the need for the NHRCK and women" s organizations to cooperate more closely on these issues was emphasized. The NHRCK agreed to hold discussion forums and informal sessions with various women" s organizations to cooperate more closely on making a more consistent and informed decision on sexual harassment cases to the extent that does not infringe on the objectivity and fairness of the decision making authority of the NHRCK.
