MND Accepts NHRCK's Suggestion to Improve Access to Military Medical Services

In May 2006, the National Human Rights Commission of Korea (NHRCK) advised the Minister of National Defense that it should guarantee soldiers" access to medical services. In response, the Minister expressed his intention of fully accepting the recommendation. The NHRCK received complaints regarding violation of access rights to medical services in the military of victims who died or became sick immediately after their discharge from military service due to lack of appropriate medical care during military service.
With regard to said complaints, the NHRCK recommended improvements of applicable legislation and the institutional mechanism to guarantee men in uniform access to medical services including (i) the right to receive timely medical services; (ii) strengthening of the obligation to prepare and keep medical records in good faith; (iii) establishment of a system to record and share medical information between military hospitals and military units; (iv) establishment of an effective cooperative medical system with civilian hospitals; and (v) procurement of necessary medical equipment in the military.
Details of said recommendation are as follows:
․ Explicit legislation of the right to receive timely medical services
- Inclusion in the (draft) Framework Act on Military Service of a provision guaranteeing soldiers" basic right to medical services
․ Specific and clear provision stipulating the legal right in order to guarantee the right practically
- Inclusion in the Ministry of National Defense Patient Management Guidelines (to be drafted as an Ordinance of the Ministry of National Defense) of additional details such as procedural simplification that enables immediate hospitalization as part of the guarantee of soldiers" access to medical services
- Enforcement of the Military Hospitals" Code of Ethics and Patients" Bill of Rights to create a patient-oriented hospital culture
․ Strengthening of the obligation to prepare and keep medical records in good faith and formulation of measures to prevent recurrence of problems
- Reinforcement of education to ensure that medical records in the military are properly prepared
- Strengthening of the obligation to keep medical records (compliance with the obligation under the Medical Act and the Medical Command" s Medical Management Regulations), etc.
․ Establishment of a system to record and share medical information between military hospitals and military units
- Completion of establishment of the DEMIS (Defense Medical Information System) for all military hospitals
- Establishment of the DEMIS in the Army, Navy, and Air Force at the division level and continued development of a remote medical service system
- Maintenance of an opinion exchange system with the Ministry of Health and Welfare as well as various civilian legal and medical information experts
․ Formulation of an effective cooperative medical system with civilian hospitals
- Provision to men in uniform of medical services comparable to those available to civilians by actively commissioning treatment of patients for procedures beyond the capacity of military hospitals to 66 designated civilian medical service providers
- Active pursuit of various approaches by establishing a military emergency patient control system in order to provide emergency patients with the best medical environment and realize active medical services in connection with civilian medical institutes
․ Procurement of necessary medical equipment in the military
- Supplementation of diagnosis devices and medical supplies of division-level medical units, early introduction of MRI and CT at front and rear-area military units, and reflection in relevant budgets of the introduction of equipment for early cancer diagnosis and cancer metastasis diagnosis
The NHRCK hails the Ministry of National Defense" s full acceptance of its recommendation aimed at improving soldiers" access to medical services. The NHRCK also hopes that such endeavor will result in substantial betterment of human rights conditions for military personnel.
