To Recommend Chairperson of Kookmin Bank To Rectify Discrimination Based on Educational Background

National Human Rights Commission of Korea (NHRCK) recommended the chairperson of Kookmin Bank to improve the employment system in order to eliminate any education-based discrimination. The NHRCK considers unnecessary the Bank" s requirement that regular recruits be graduates of universities or have equivalent or higher educational backgrounds.
Based on a complaint filed by a 32-year-old woman known only as Chung in May 2005, the NHRCK conducted investigation of Kookmin Bank and the complainant. The NHRCK confirmed that " personal and corporate finance" , an area of business for Kookmin Bank" s recruits meant the overall business activities being performed by personal and corporate finance branches of the Bank and that those who majored in business administration, law, and accounting were not the only ones hired by the Bank for execution of said business affairs. In addition, it was revealed that new recruits were not immediately assigned to what are called core functions by the Bank.
According to the findings by the NHRCK, most employees are deployed to perform those functions only after a certain period of service with the Bank, and only 1,280 out of 17,317 regular employees of the Bank are engaged in those affairs. Moreover, even the Bank" s job description does not stipulate that employees performing such affairs should at least be university graduates.
NHRCK determined that this restriction constituted employment discrimination against people with college or lower diplomas since it deprived persons other than university graduates and people with higher educational qualifications of opportunities for employment as regular workers even though they have the potential to develop their capabilities through job experience. The NHRCK recommended improvement to the employment system as it imposed certain needless limitations based on educational background.
For reference, the NHRCK recommended on July 20, 2006 that the Enforcement Rule of Law Enforcement Officer Employment Ordinance be revised since the requirement by the National Policy Agency that candidates for employment of officers handling foreign affairs should be at least university graduates constitutes infringement upon the right to equality without any justifiable cause.
