NHRCK Holds the '2006 Human Rights Education Practice' Conference

A longstanding and unwritten policy at one of the local broadcasting companies that required women to resign once they get married is sex discrimination on the basis of one" s martial status. A petitioner complained that although it was not a formal policy of the broadcasting company that women leave the company when they get married, all the employees acknowledged this to be the case. The company would persistently suggest and put pressure on women contractual employees to leave the company when they get married and under this unwritten policy the petitioner claimed she was forced to resign right before her marriage. She filed a petition at the NHRCK in September 2006 arguing that this practice amounted to sex discrimination.

Since the petitioner left the company against her will because of the sexually discriminatory practice of women employees being asked to resign upon marriage, the NHRCK recommended that the company reform this practice, establish a policy to prevent the practice from recurring and notify all employees about the recommendation.

Upon considering arguments from both sides, the NHRCK concluded that the petitioner left the company against her will due to the discriminatory practice persisting at the company. The conclusive facts were △ currently there are 12 married male employees out of a total 16 male contractual employees, △ 4 out of 6 contractual female employees, 2 out of 3 full-time female employees, and one employee who resigned stated that there exists such discriminatory practice, and △ the petitioner was put at a financial disadvantage since the income from working as a freelancer is less than the amount she received while working at the company. Starting from this decision, the NHRCK expects that the old-fashioned practice of women being forced to leave work once they get married be abolished and that marital status of women no longer be an obstacle for women actively participating in society.
