Recommendation to Improve the Military Food Service Environment to Guarantee the Right to Health of Servicemembers with Special Dietary Needs
The Military Needs to Institutionalize a Support System for Servicemembers Requiring Vegetarian Meals, Religious Meals, or Accommodations for Food Allergies or Health-Related Dietary Restrictions
□ The National Human Rights Commission of Korea (Chairperson Ahn Chang-ho, hereinafter "the Commission") reviewed the results of its 2023 "Survey on the Military Food Service Environment for Servicemembers," together with materials submitted by the Ministry of National Defense, the Military Manpower Administration, and each branch of the military from 2024 through February 2026. Based on this review, the Commission issued the following recommendations on June 18, 2026 to the Minister of National Defense, the Chiefs of Staff of each branch of the military, the Commandant of the Marine Corps, and the Commissioner of the Military Manpower Administration, in order to guarantee the right to health of servicemembers with special dietary needs:
1. To the Minister of National Defense:
▲ Promote amendments to the Framework Act on Military Food Service or its subordinate statutes so that they incoporate the concept and scope of servicemembers with special dietary needs, the State's duty of protection, and basic principles of support; ▲ Provide for the "service of servicemembers with special dietary needs" in the Directive on Unit Management, and specify "protection of the human rights of servicemembers with special dietary needs" as a component of human rights education under the Directive on Military Human Rights Affairs.
2. To the Minister of National Defense, the Chiefs of Staff of each branch of the military, and the Commandant of the Marine Corps:
▲ Clearly integrate, in the Ministry of National Defense's food service policy and each branch's food service guidelines, that protecting servicemembers with special dietary needs is a basic responsibility of the military, and establish clear standards for the scope of those eligible for support and the basic principles of operation; ▲ Ensure that the obligation to notify and label allergen-containing ingredients under Article 7 of the Enforcement Rule of the Framework Act on Military Food Service is consistently implemented across the food service policy, each branch's food service guidelines, and the operation of food service contractors; ▲ Establish the standards necessary to operate a range of alternative meal options, such as substitute side dishes, substitute beverages, meal choices, and substitute desserts, while limiting the allocation of cash to a supplementary and exceptional measure used only where support cannot be provided through the military's internal food service system; ▲ Establish standards for managing information on, and protecting the personal data of, servicemembers with special dietary needs, covering vegetarianism, religious dietary requirements, food-allergy-related restrictions, and health-related dietary restrictions, standardize the items surveyed, reporting cycle, and reporting format, and ensure that the resulting information is linked to actual food service support; ▲ Establish contract standards, operational evaluation criteria, training, and work guidelines to ensure that support for servicemembers with special dietary needs is substantively implemented in privately contracted food services as well.
3. To the Minister of National Defense and the Commissioner of the Military Manpower Administration:
Establish standards for linking and utilizing dietary-related information collected during the military service eligibility examination and enlistment examination stages, so that this information can be used for actual food service support at each branch, in basic training centers, and during service at assigned units.
4. To the Commissioner of the Military Manpower Administration:
Revise the relevant forms, such as the personal information statements completed during the military service eligibility examination and enlistment examination, so that they capture not only whether an individual is vegetarian, but also whether the individual requires religious meals, has food allergies, or has health-related dietary restrictions.
□ The Commission found that, military food service goes beyond the mere provision of welfare or convenience and constitutes a basic condition for maintaining health and performing military service in a stable manner, because servicemembers residing on base, cannot freely choose their meals or procure alternative meals from outside the base, .
□ In particular, servicemembers with food allergies can suffer harm to their health merely from consuming certain ingredients or from cross-contamination. For vegetarian servicemembers and those who require religious meals, issues of freedom of conscience and freedom of religion may also be implicated. The Commission therefore determined that support for servicemembers with special dietary needs is not a matter of exceptional requests by individual servicemembers or discretionary consideration by individual units, but a task of guaranteeing fundamental rights that the military must manage in a systemic manner.
□ In addition, the Commission found that dietary-related information collected during the military service eligibility examination and enlistment examination stages is not being sufficiently linked to actual food service support during basic training and service at assigned units. It also determined that each branch's methods of identifying the relevant servicemembers, survey items, reporting cycle, reporting format, and personal data protection standards need to be standardized.
□ Through this recommendation, the Commission hopes that an institutional foundation will be established so that servicemembers with special dietary needs can disclose their dietary needs without fear of disadvantage or stigma, and can reliably receive the food service support they require.
