[Recommendation] Arbitrary age limitation in recruiting a care-taker is discrimination

o NHRCK recommended to the president of K Care-takers Association to improve its selection criteria that has age limitation in recruiting care-takers.

 

o The Complainant who was 69 years old tried to join the K Association as he had 1-grade Nursing Certificate. However, he was rejected because of his age and he filed a complaint to NHRCK.

 

o Investigation of NHRCK confirmed that the Association allowed people aged between 40 to 55 to join the association. Among people aged 55 and above, those who are healthy are allowed to join the association. However, when the association rejected complainant’s application, they did not had any process to check complainant’s health.

 

o Discrimination Rectification Committee of NHRCK concluded that the Association arbitrary had age limitation and rejected application without reasonable ground and such rejection is exclusion of and unfavorable treatment against specific group based on the ground of age.

 

o Hence, NHRCK advised Minister of Employment and Labor to enhance related rules to ban discrimination in employment based on age and help aged people to be employed in proper positions.
