NHRCK recommended NAP on Business and Human Rights to the Government

The National Human Rights Commission of Korea devised the National Action Plans on Business and Human Rights (NAP on BHR) and recommended it to the government in a bid to encourage business to carry out human rights friendly activities, pursue sustainable development and promote competitiveness on global market, and to enhance consistency and efficiency of national policies in regards to business and human rights.

 

The NAP on BHR is a comprehensive and systematic national plan of action devised in a bid to prevent human rights infringements by enterprises and encourage business to contribute to promotion of human rights by carrying out human rights friendly business activities.

 

The recent damage incurred by humidifier sanitizer is notable example of violation upon the right to health and life of consumers by business which led to massive and serious damages. As such, activities of multi-national enterprises often lead to human rights infringements.

 

The international community is paying great attention to the issue of business and human rights. The UN Human Rights Council adopted the 'UN Guiding Principles on Business and Human Rights' in 2011 and recommended states to devise a national action plan on business and human rights in a bid to encourage states to implement the UNGP and in 2014, the UN Human Rights Council proposed a guidance to do so.

 

In 2015, the G7 Summit welcomed and supported efforts of the UN to establish the NAP on BHR. As of now, 10 countries including the UK and Denmark have established and 19 countries including the US and Germany are in progress to establish the NAP on BHR.

 

The NHRCK, in line with the international trend, carried out researches annually on business and human rights from 2008. Based on the result of researches, the NHRCK published a report on business and human rights(2013) and a Guideline and Checklist on Human Rights Management(2014) and recommended it to public institutions to encourage them to reflect the guideline and checklist in their management.

 

Recent efforts of the Commission to encourage implementation of the UN Guiding Principle on Business and Human Rights include recommendation to enhance assessment system for performance of public institutions and recommendation on NAP on BHR(2016).

 

NHRCK took strategic approach in devising the recommendation to include contents that fit the reality in Korea which include systematization of human rights management in public institutions, encouragement of human rights management in conglomerates and establishment of procedure for remedy for victims of human rights infringements.

 

To this end, the Commission divided the recommendation into nine tasks and proposed main goal for each task.

 

The Commission hopes that the Korean government establishes a NAP on BHR which not only supports human rights friendly management by companies and sustainable development, but also fulfills its responsibility to protect its people's life and safety from hazardous products.
