Ministry of Health and Welfare accepted NHRCK recommendation to install slope for people with disabilities

 

o National Human Rights Commission of Korea recommended to the Ministry of Health and Welfare to take necessary measures to mandate installation of accommodation including a slope for people with disabilities in small-sized public facilities, and the Ministry accepted the recommendation.

 

o NHRCK concluded that small-sized public facilities including restaurants, convenient stores, and pharmacies are facilities that are essential to people’s daily lives regardless of their size, and thus, the right to access of people in wheelchair has to be guaranteed. NHRCK recommended to make an amendment to the ‘Act on guarantee of promotion of convenience of persons with disabilities, the aged, pregnant women, etc.’ to mandate provision of accommodation in public facilities sized bigger than 50 square meeters that are newly built, extended or reconstructed after January 1, 2019.

 

o The Ministry of Health and Welfare replied that it currently commissioned a research to devise detailed standards to implement NHRCK’s recommendation, and it plans to make an amendment to related legislation and secure necessary budget until 2019 and implement in 2020.

 

o Meanwhile, the Ministry of Strategy and Finance did not accept NHRCK’s recommendation to amend the Restriction of Special Taxation Act to provide tax credits for the expenses invested to install accommodation in public facilities for people with disabilities. The Ministry stated that the subject for tax credits might excessively be expanded, and there is a need to consider a fairness issue regarding provision of tax benefits to rental business operators with high income.

 

o With regard to NHRCK’s recommendation to amend the Road Act to reduce occupancy charges on road to minimize the burden on facility owners incurred by installation of accommodation including a slope in small-sized public facilities, the Ministry of Land, Infrastructure and Transport stated that providing reduction of occupancy charges to all facilities related to people with disabilities is difficult given other related regulations and fairness compared to other people occupying roads.

 

o NHRCK considered that such stance of the Ministries is attributable to lack of understanding on the right to access of people with disabilities and lack of will to improve systems, and it officially announced non-acceptance of recommendation pursuant to Article 25.5 of the National Human Rights Commission Act.
