Restriction on people with color blindness is human rights violation and discrimination

o National Human Rights Commission of Korea recommended to the Chief of the National Police Agency to amend the regulation that completely prohibits people with color blindness from applying for police officer.

 

o In 2016 and 2017, NHRCK received complaints that people with color blindness are restricted in applying for police officer which infringes upon their right to hold public duties and freedom of vocation and they are discriminated based on physical condition.

 

o The National Police Agency replied that police officer is required to distinguish colors given the characteristic of duties, and under the job rotation system, they are given duties in diverse fields. It added that hence, it is inevitable to restrict application of people with moderate and severe color blindness.

 

o However, NHRCK investigation showed that pursuant to the color blindness test by the National Police Agency, test result was different from person to person even when they are in same category of moderate or severe, and some of them distinguished all colors.

 

o In addition, 2009 and 2011, NHRCK recommended to the Chief of the National Police Agency to amend the rule on restriction of application of people with color blindness after confirming that there are duties that do not require ability to distinguish color such as communication. The National Police Agency did not accept the recommendation.

 

o For this case, the police argued for job rotation system, but they didnt submit exact status of job rotation or areas that requires distinction of colors.

 

o Accordingly, NHRCK recommended to the Chief of the National Police Agency to make an amend to article 34.7 on physical condition of Rule of Implementation of the Decree on Appointment of Police Officer which prohibits application of people with color blindness regardless of the duties that they are applying for.
