NHRCK recommended for introduction of mandatory notification of birth

o NHRCK decided at its standing committee to recommend to the Minister of Justice and Chief Justice of the Supreme Court to make an amendment to the Act on the Registration, Etc. of Family Relationships to mandate doctors and maternity nurses involved in childbirth to notify the birth of a child to national institution.

 

o Through 2015 Monitoring on Human Rights of Child, NHRCK identified cases where a child is exposed to child abuse because birth registration did not took place. In many cases, their parents, who are obliged to register the birth do not want to register the birth, or due to legal and institutional limit, birth registration could not take place. A child is officially exists through birth registration and then enjoy basic rights guaranteed by the state and society. It is hard to identify child abuse or medical and educational neglect if birth registration do not take place.

 

o Hence, NHRCK recommended to amend the act to mandate doctors and maternity nurses involved in childbirth to notify the birth to national institutions, with the duty to birth registration given to parents. NHRCK concluded that if state has information on childbirth, it will be able to track a child whose birth is not registers and thus prevent child abuse.

 

 

o International community also emphasizes that birth registration is crucial in guaranteeing the basic rights of child. In 2011, the UN Committee on the Rights of Child recommended to Korea to introduce a system that allows birth registration of every child without discrimination, so did the UN Committee on Social, Economic and Cultural Rights this year.

 

o Against this backdrop, NHRCK hosted a panel discussion regarding introduction of a system for universal birth registration on 27 November. NHRCK hopes that the discussion served as an opportunity to introduce a system that allows birth registration of every child without discrimination.
