NHRCK holds a Session to discuss the Domestic Implementation of Individual Communications
The National Human Rights Commission of Korea(Chairperson Doohwan Song, hereinafter the ‘Commission’ or the ‘NHRCK’) held a discussion session to find measures to domestically implement the decisions(opinions) made by the UN Human Rights Treaty Bodies regarding individual communications. Individual communication is a complaint filed by an individual to the UN Human Rights Treaty Bodies, hoping to vindicate his or her rights at the international level.
In 2003, the Commission recommended legislating an enforcement decree for the domestic implementation of the UN Treaty Bodies’ decision on the individual communications. The recommendation, however, is yet to be carried out.
The discussion session began with the keynote speech by Hyesu Shin, a member of the UN Committee on Economic, Social and Cultural Rights, on the ‘current status and the ways for improvements in the system of domestically implementing the decision made at the UN Treaty Bodies on individual communications’
The representatives from the Ministry of Justice, the Ministry of Foreign Affairs, the Judicial Policy Research Institute, the National Assembly Research Service and civil society organizations participated as panels for the concussion.
the NHRCK plans to formulate a comprehensive recommendation to improve the way the decisions are implemented domestically with the outcomes from the fruitful discussion.
